KEVIN D. HUGHES
He graduated from Columbia Law School in 1993, where he was a Harlan Fiske Stone Scholar and Articles Editor of the Columbia Journal of Law and Social Problems. He received his Bachelor of Arts Degree in 1990 from the University of Michigan (Ann Arbor), graduating with honors. Prior to joining Tisdale & Nicholson, Mr. Hughes was a litigator with Washington, D.C. –based Hogan & Hartson, and then in Los Angeles, with Greenberg Glusker Fields Claman & Machtinger. He is licensed to practice law before all California state courts, the United States District Courts for the Central, Southern and Northern Districts of California, and the United States Court of Appeals for the Ninth Circuit. He is a member of the California, District of Columbia and Maryland bars. Mr. Hughes has served as lead counsel in numerous trials and arbitrations, as well as appeals before the state and federal bench. Mr. Hughes brings to his entertainment litigation practice a measure of experience as an author, himself, having written a novel, six feature-length screenplays and four TV sitcom scripts. |

Representative Matters: ¨ Successful defense of writ of attachment proceeding brought by "Biggest Loser" reality show fitness guru and television production company on behalf of home entertainment company. Settled accounting claims brought by production company after two-week arbitration. ¨ Successful copyright and trade dress suit on behalf of owner of website for popular online role-playing video game against competing site that duplicated various creative elements as well as website's distinctive "look and feel". ¨ Argued before Ninth Circuit and won reversal of lower court ruling that Marin County owned copyright in client’s widely-used government records retention schedules as a work-made-for-hire. Click here to view opinion. ¨ Lead counsel in month-long jury trial and obtained substantial verdict for fraud, product liability and punitive damages on behalf of veterinary penicillin manufacturer against the nation’s third-largest seller of microbiological supplies. ¨ Obtained Ninth Circuit ruling precluding prominent (but suspended) civil rights attorney from practice before C.D. California and obtained dismissal of underlying suit. ¨ Represented telecom hardware re-seller in million-dollar embezzlement action against both its former bookkeeper and a national banking institution. Recovered 92% of the stolen funds. ¨ Successfully defended Beverly Hills art dealer in an accounting dispute with co-venturer. Lead counsel in three week bench trial. ¨ Successful Labor Commission petition on behalf of nationally-syndicated radio morning show personality against his former manager. ¨ Obtained favorable settlement for trendy Hollywood furniture boutique in unfair competition suit against co-owner.
